OUCH MUSIC ACADEMY TERMS AND CONDITIONS

Missed Classes and Punctuality 

• Students are obligated to maintain punctuality and consistent attendance in all scheduled classes.

• The School is not obliged to provide make-up time or additional instruction to absentees or latecomers. Teachers may exercise their discretion to do so, provided it does not impact the subsequent student's class.

• A suitable substitute teacher may be appointed if the assigned teacher is unable to attend class. However, should a substitute teacher be unavailable, the class will be rescheduled to a mutually convenient time and date if deemed necessary.

Cancellation 

• A minimum of 24 hours' notice, provided within working days and hours, is required from the student or parent for class cancellation or rearrangement. The School retains the discretion to reschedule the class or extend single or multiple classes to compensate for the missed hours.

• Replacement classes may be carried forward for a maximum period of 90 days. Should a claim not be submitted within this 90-day period, the classes will be rendered invalid. Missed classes shall not be applied as a deduction against the monthly fee.

• The School reserves the right to appoint different instructors for the purpose of conducting replacement classes.

Freezing of Classes

• Students may request a temporary suspension of classes for a maximum duration of one (1) to two (2) months, provided that the School receives notification two (2) weeks prior to both the commencement of the leave and the monthly billing cycle date, which falls on the 21st of every month.

• Notifications received after the billing cycle date will result in the automatic imposition of the monthly fee, and the freezing fee will be applied in the subsequent month due to established system protocols. For example: the billing cycle is the 21st of every month, and a member submits a freeze notification on the 22nd, the monthly fee for the current month will still be charged, and the freezing fee will appear on the next month's statement.

• A non-refundable freezing fee of RM 50 shall be levied to reserve the class slot and maintain the student's status with OUCH Music Academy.

• The freezing fee is strictly non-refundable and cannot be credited towards or utilized as payment for the monthly tuition fee.

• No replacement classes will be scheduled or conducted during the period of class suspension.

• The School reserves the right to reallocate a student's reserved class slot if classes are suspended without official notification or the required payment is not secured. The School is not obligated to inform students or parents of this change.

• Should a student fail to notify the School prior to the suspension of classes or be absent for a continuous period exceeding two (2) months without notification, the School reserves the right to require the student to undergo the re-registration process for class enrolment.

Instrument Study

• Instrument studies for students under the age of 18 will be conducted with a ratio of two students per classroom.

• The School may grant requests for individual lessons when a personalised instructional approach is deemed necessary for a specific instrument. In the absence of such a requirement, instrument study will be conducted with two students per classroom.

• The school reserves the unqualified right to change instructors for any valid reason. Instructors will be selected based on their qualifications and experience relevant to the chosen lessons. A comprehensive handover of student progress from the previous instructor will be completed to ensure a seamless transition.

• Students are required to adhere to the teaching materials and tools suggested by the instructor for the lessons. The cost of these materials and tools is separate from the monthly tuition fees.

• The school administers yearly graded assessments to evaluate the individual performance of students enrolled in OUCH Music Academy.

Adult Contemporary 

• The Adult Contemporary Course is structured into six levels, designated Level 1 through Level 6. The grading system aligns with those of major examination boards, namely ABRSM, RSL, and Trinity.

• A student's level will be determined by the school based on their existing musical background (on the same instrument), according to the following equivalencies:

  • Grade 0-1 - Level 1

  • Grade 2 - Level 2

  • Grade 3 - Level 3

  • Grade 4 - Level 4

  • Grade 5 - Level 5

  • Grade 6 - Level 6

• For students with prior musical experience, a one-on-one assessment will be conducted to accurately determine the appropriate level.

• Students will advance to the next level following six continuous months of active study at the school.

• Lessons necessitate that students adhere to the teaching materials and tools recommended by the instructor. The cost of these materials is separate from the monthly tuition fees.

Group Class

• Any missed group class may be replaced, subject to availability in existing slots scheduled by the school.

• The school enforces a no-parents-in-classroom policy for students aged 3 years and above.

• Classes missed due to the student’s refusal to enter the classroom are neither replaceable nor refundable.

Examination

• Students may only register for examinations with the guidance and agreement of their teacher.

• Examination fees must be settled upon receipt of the email confirmation.

• Examinations will be scheduled and processed solely after the full payment has been received.

• Specific examinations necessitate the services of an accompanist. The School furnishes examination accompanists for a stipulated fee. External accompanists are not permitted.

• Students who do not participate in examinations will be evaluated using the "Student Assessment Report."

• OUCH Music Academy (OMA) will not be held liable for any unsuccessful examinations arising from non-compliance with external examination policies.

Discipline

• Students are required to maintain appropriate conduct on school premises at all times.

• Any instance of inappropriate behavior by a student will be subject to observation by the school management. Disciplinary measures, including but not limited to the discontinuation of classes, may be imposed if a student's actions cause significant disruption or discomfort to others.

• Any damage to furniture, instruments, equipment, or other school property caused by a student will be the responsibility of the student (or parent/guardian), and the school reserves the right to seek financial compensation as deemed appropriate.

• School and office operational hours are:

1. Tuesday - Sunday 10am - 8pm for OUCH @ The Campus Ampang

2. Wednesday - Sunday 11am - 8pm; Saturday - Sunday 9am - 6pm on weekend for OUCH @ Vida Bukit Ceylon

• Enquiries will be dealt with immediately, where possible, during regular office hours.

Holidays

• OUCH Music Academy observes the 5 compulsory Public Holidays which are:

1. National Day

2. Malaysia Day

3. Labour Day

4. Yang Di Pertuan Agong’s Birthday

5. Federal Day for KL/ Sultan’s Selangor’s Birthday for Selangor

Classes that fall in the category above will not be replaced. 

• The additional 8 public holidays that we observe:

1. New Year’s Day

2. Chinese New Year (2 days)

3. Hari Raya Aidilfitri (2 Days)

4. Hari Raya Haji 

5. Deepavali 

6. Christmas 

     Classes that fall in the category above will not be replaced. 

• OUCH Music Academy will be opened on Public Holidays below:

1. Thaipusam - KL & Selangor

2. Nuzul Al - Quran - KL & Selangor

3. Wesak Day - KL & Selangor

4. Awal Muharam- KL & Selangor

5. Prophet Muhammad’s Birthday

Classes that fall in the category above will not be replaced if a student missed a class. 

 

Term Breaks

• The school will have 2 term breaks per year. 1 during the end of the year & another 1 in between May - July depending on the number of weeks in that month. During this break, there will be no replacement classes for the class missed. 

• All term breaks will be announced at the beginning of the year and will be displayed at the school reception.

Photography

• Photographs will be taken for publicity purposes. Do inform the OUCH Management Team if you wish to be excluded from photoshoots. 

• The exclusion will not apply to official school concerts & performances that involve a group of students.

Fees

• The fixed monthly fee is calculated based on four weekly classes per month. The complimentary fifth week, when applicable, serves as compensation for the two annual term breaks observed by OUCH Music Academy.

• The fixed monthly subscription fee applies to enrolments with a minimum duration of three months.

• Enrolments of less than three months will be classified as short-term, and a revised fee structure will apply.

• Fees will not be prorated or reduced due to student absences.

• All payments and transactions must be made exclusively in Ringgit Malaysia (RM).

• Payments are accepted via credit cards, bank transfers, e-wallets and direct debit services through the school's authorised payment platforms.

• All students are required to enrol in the payment method designated by the school, including automatic or recurring payment arrangements where applicable.

• Cheque, cash and in-person card payments are not accepted.

• Admission requires payment of a non-refundable RM100 registration fee, the first month's tuition fee and a deposit equivalent to one month's tuition fee upon registration.

• The one-month fee deposit is non-refundable in cash and shall be utilised exclusively towards payment of the student's final month of enrolment upon withdrawal, subject to the school's withdrawal policy.

• The fee structure may vary according to special promotions offered by OUCH Music Academy at the time of enrolment.

Payment Due Dates, Late Charges & Suspension of Lessons

• Monthly Payment Due Date: All monthly tuition fees are due on the 1st of each month, regardless of the student's scheduled lesson dates.

• First Late Payment Charge: Payments remaining outstanding after the 7th of the month will incur a late payment charge of RM10.

• Additional Late Payment Charge & Suspension: If payment remains outstanding on the 15th of the month, an additional RM20 late payment charge will be imposed, bringing the total late payment charges to RM30. All lessons will be automatically suspended until the outstanding amount and applicable charges are fully settled, subject to the following provision.

• Outstanding Fees Beyond the 21st: Where payment remains outstanding after the 21st of the month, the student will be required to settle both the outstanding month's tuition fees and the following month's tuition fees, together with all applicable late payment charges, before lessons can resume.

• Reactivation of Lessons: Suspended lessons will only resume upon confirmation of full payment of all required outstanding fees and applicable charges. Resumption of lessons shall be subject to the school's scheduling arrangements.

• Lessons During Suspension: Lessons missed during a payment-related suspension shall not be eligible for replacement, refund, fee reduction or carry-forward.

• Payment Obligations: Temporary suspension of lessons does not constitute withdrawal from the school and does not release the student or parent/guardian from outstanding payment obligations.

• Purpose of Policy: This policy is implemented to support the smooth operation of the school, ensure timely financial commitments to teaching staff, and enable OUCH Music Academy to dedicate its resources towards maintaining and improving the quality of its educational programmes and services.

Billing

• The OMA's billing cycle commences on the 21st of each month.

• The payment due date is the 1st of every month (payment required in advance).

• Monthly fees must be settled no later than the 1st day of each month. Receipts will be furnished upon request through the school administration via email or WhatsApp.

• Lesson materials and aids (such as books, tuners, shoulder rests, etc.) are subject to separate charges.

• The school reserves the right to deactivate a student's enrolment status for payments received later than the 7th day of the month without prior written or verbal notification. This situation is designated as "non-payment".

• Deactivated students are required to remit a full month's fee to resume their lessons, provided that the slot remains available and the resumption date falls within the same calendar month. Resumption beyond the current month will necessitate the student's re-registration with the school.

• Pro-rata adjustments, discounts, and replacement classes will not be offered for classes missed as a result of non-payment.

Withdrawal/ Termination

• Formal notification of withdrawal must be submitted in writing through the school's official communication channel.

• The notification must be provided by the billing cycle date, which is the 21st of every month.

• Any notification received after the 21st will result in the billing of the following month's fees as per normal, and the withdrawal will take effect the month after. For example: If notification is received on 21st March, there will be no charge for April, and classes will conclude by the end of April. / If notification is received on 22nd March, April will be charged, and the membership will end by the conclusion of May.

 

The management reserves the right to update the school policy from time to time without prior notification.
